Annals Of Ugh!: Dolphin-Assisted Birth

You just can’t make this sh*t up:

Last month, Adam Barringer, 29, and his pregnant wife Heather, 27, boarded a plane for Hawaii. The couple traveled over 4,500 miles in the hopes of welcoming baby Bodhi into the world during a dolphin-assisted birth in Pohoa, Hawaii.

The couple will stay and study with Star Newland, founder of The Sirius Institute, a consortium with the purpose of “dolphinizing” the planet.

Heather and Adam’s idea to welcome their first child into the world via water and hopefully dolphins, was inspired by the book, “The Ancient Secret of the Flower of Life” by Drunvalo Melchizedek.

Before they learned they were pregnant, the idea of a water-and-dolphin birth appealed to Heather and Adam and they say they have experienced signs along the way, pointing them to Hawaii and the institute. Preparations for a dolphin-assisted birth began as soon as they arrived, long before Heather’s July due date.

At the institute, the couple will spend time in the water, forming a connection with a dolphin pod they hope will bond with them and ultimately their newborn.

“It is about reconnecting as humans with the dolphins so we can coexist in this world together and learn from one another,” says Heather.

Can You Eat Tuna Without Harming Dolphins?

My sense is: no.

This is a very complex subject. And while I applaud all efforts to create and enforce “dolphin-safe” practices, every time I read about how tuna are fished across the oceans, and the regimes used to try and protect dolphins, it just seems apparent that the problem of dolphin bycatch (along with bycatch of many other types of fish), as well as holes in the various dolphin-safe regimes and their enforcement, are significant.

For example, here is the Washington Post, on Mexico’s argument that US dolphin-safe regimes unfairly burden Mexican tuna fishermen:

Mexico’s challenge is an attempt to increase its $7.5 million share of a U.S. tuna import market worth more than a half-billion dollars. But it also raises questions for U.S. consumers about whether the tuna they eat is truly “dolphin safe” — not sold at the expense of a mammal Americans cherish.

There is no sure way to catch tuna without harming other marine life. Dolphins, as well as sharks, turtles and other animals, are unintentionally killed as bycatch in the quest for tuna.

The central question facing governments, corporations, environmentalists and consumers is how much is too much, and whether using a huge net to catch tuna in one part of the ocean is any worse than using them to catch it in other parts.

The World Trade Organization recently agreed with Mexico’s claim that U.S. regulations in the eastern tropical Pacific Ocean, where the Mexican fleet fishes, are far more restrictive than they are for the western and central Pacific where the U.S. fleet fishes.

In response to the WTO ruling, the United States proposed a new rule to strengthen protections for dolphins wherever tuna is fished. The comment phase for the rule closed last week.

The proposal, drafted by the National Oceanic and Atmospheric Administration, has one change that irks Mexico — allowing captains in the western and central Pacific to self-certify they are not taking dolphins as bycatch.

“The objective . . . was to assure no dolphins were injured, and you’re not doing that,” said Mark J. Robertson, president of Potomac Global Advisors, which advises companies and governments in international disputes. “How practical is it to trust captains to say how many dolphins they harmed?”

There is no question that the dolphin-safe regimes, and efforts to improve them, save dolphin lives. But there is also no question that eating tuna currently (and probably always will) involves the death of dolphins and other fish species. So anyone who truly cares about dolphins, or wants to eat ethically, should simply stop eating tuna (and, yes, I believe that true ethical eating requires not eating ANY fish, but I find the moral cost of tuna, likely involving hundreds of thousands of dead dolphins every year, to be particularly egregious).

Video Smackdown: Marineland vs. Taiji

Video is a powerful medium for trying to shape opinion and emotion, a point that is made by two videos which I came across this morning.

One, from Marineland Canada, aims to convince the public that allegations of animal cruelty at Marineland are false.

The other, from a group of citizens dedicated to trying to end the Taiji dolphin hunts, aims to mobilize public opinion against captivity and Taiji.

It’s interesting to see them both together. What strikes me is that the anti-captivity side has more powerful material to make their case.

The “Dolphin-Safe” Fiction

Well, we looked at the humane slaughter fiction, so why not another one?

This sort of story is the reason I don’t eat any seafood. No matter how many assurances you get that it is “safe,” or “sustainable,” or whatever, the truth is that you can’t really be sure, and that very little is what it seems when it comes to the fishing industry. Read the whole thing, but here is a key moment:

When we arrived, what we found totally broke our hearts. About 1000 beautiful, divine Spinner Dolphins were inside their big net, swimming in circles, afraid and confused. We saw a little baby dolphin outside the net swimming around like crazy trying to reach his family. I filmed it all. I filmed them pulling in the nets, I filmed when several of their guys, upon seeing us, jumped into the water to try to free any stuck dolphins.

The two daughters, OMG I LOVE them, wanted to get in and check it out so we jumped in and swam to the net and the sound was heartbreakingly deafening. The dolphins were crying out, making all kinds of strange sounds, and the little dolphin outside kept racing by, in a total panic.

Once the net was in more than half way, several more guys jumped into the water and the speed boats came out and they started to try to pull one side of the net down so that the dolphins could get out. This is the standard practice called “backing down” the net which if they do it, they are allowed to call their tuna “dolphin safe.” What a fricken JOKE!!! The dolphins were in total panic and confusion and totally stressed. Not only that, it took several times to get all the dolphins out, with over 45 minutes in between so the group was totally split up and freaked out. Not only that, but the guys were pounding on the water to frighten the dolphins into swimming out of the net but they were so afraid and confused that it just made it worse. (Read on).

I know there is a rational argument that says that the dolphin-safe program, for all its flaws, saves the lives of many dolphins. I believe that to be true. But I think it also encourages the consumption of tuna because it allows shoppers to buy tuna in good conscience, and to believe dolphins aren’t dying for their love of tuna. But as this story shows that is likely not the case. And if people clearly understood that eating tuna is killing dolphins, demand for tuna would go down, which might be an even better way to reduce dolphin deaths.

Maybe, instead of a dolphin-safe label,we should have a different label, which says: “The product you are about to consume kills dolphins.” That, arguably would save more dolphin lives than a flawed “dolphin-safe” program that obscures the truth of what really happens out there on the ocean. (Now that I think of it, a whole series of food labels, akin to cigarette warnings, which captured health and environmental impacts, would be awesome).

(Yet!) One More Round On The Taiji Cruelty Report

Following the recent release of a paper on the inhumanity of the Taiji dolphin drive hunt (previous here, here, here, and here!), Lori Marino of Emory University voiced strong concerns about the language and approach of the paper, most prominently here.

Lori is as passionate, dedicated, and smart as they come when it comes to advocating for the rights of nonhumans. And she bravely raised completely legitimate points (though I personally did not agree completely with them). But she has reconsidered the sharpness and tone of her response, and has just released an open statement to the report authors:

In response to the outpouring of strong reactions to this paper, both negative and positive, I need to say that my own criticisms of the paper reflect a very deep commitment to a particular stance on how we should oppose dolphin exploitation and abuse. They were not meant as a personal attack on the motivations of the authors, and I apologize and take full responsibility for any hurt the tone of my reaction and my comments have caused.

We are all frustrated over the ongoing abuses of dolphins and other animals. And we all have strong opinions about how to bring an end to those abuses. My own view is that a strong rights-based stance is the only one that will lead to real change, and that when we give the impression that we’re endorsing more “humane” ways of killing nonhuman animals, we have stepped over a “line in the sand” with regard to being respectful to the lives of the animals we are setting out to protect.

So I have very real concerns that a paper of this kind can backfire in terms of our goal, despite the good intentions.

More to the point, there is a respectful discussion to be had about these issues, and my reactions to this paper should have been more considerate and constructive.

I hope, in the future, to be able to reach out to my colleagues and friends as we all work to find ways to combat the abuses all around us – abuses that clearly leave deep marks on all of us.

I personally have no problem with sharp debates over this issue, or any issue. But it is important that debates not undermine the basic collegiality of all who care about dolphin issues, or undermine their ability to work together toward protecting dolphins. So I think this is a classy move on Lori’s part and I hope it succeeds in soothing any hurt feelings or ill will.

Another Round On The Taiji Cruelty Report

After I wrote over the weekend about new research on the killing methodemployed in the dolphin roundups undertaken in Taiji, Japan, a fascinating comment on the rights of “nonhuman persons” was posted by Thomas I. White, who is the Conrad N. Hilton Professor in Business Ethics at Loyola Marymount University in Los Angeles…[snip]

…An issue that quickly comes to mind in considering such questions is where one draws the line in determining how we treat the animals we come across in the wild or rely on — from horses and dogs and cats to the cattle, poultry, pigs and other creatures we grow in order to consume. Here’s the comment White made, which got Revkin interested in exploring this further:

One of the most important features of science is that major discoveries regularly raise important ethical questions. This is especially true with research about cetaceans, because the discoveries of marine mammal scientists over the last 50 years have made it clear that whales and dolphins share traits once believed to be unique to humans: self-awareness, abstract thought, the ability to solve problems by planning ahead, understanding such linguistically sophisticated concepts as syntax, and the formation of cultural communities. The scientific evidence is so strong for the intellectual and emotional sophistication of dolphins that there simply is no question that they are ‘nonhuman persons’ who deserve respect as individuals.

Anyone who doubts this either is unfamiliar with the data or doesn’t understand the ethical significance of it. Both the killing and captivity of dolphins are ethically indefensible. This is not an emotional claim. It is based on hard science, and distinguished scientists like Lori Marino, Denise Herzing and Hal Whitehead recognize this. It’s important to recognize that facts that we now consider obvious–the Earth moves around the Sun, matter consists of invisible subatomic particles, men and women are equal, to name just three–were all considered ridiculous. Science moves forward by being open to the idea that radical ideas–in this instance, that dolphins ‘count’ as individuals and should be neither killed nor held captive–might just be true.

It’s always refreshing to see such a clear declaration of the moral and scientific case for nonhuman rights. Whatever you might think of the Taiji report, it has generated a lot of worthwhile attention and discussion to the issues of cruelty in the drive hunt, and dolphin rights.

A Deep Dive Behind The New Report On Taiji Cruelty

Courtney Vail, one of the authors of this newly published paper detailing the extreme nature of the killing methods used in the Taiji dolphin drives, explains in more detail how off the charts the killing methods really are:

But what hasn’t changed is the desire of the fishermen to keep the activities in the cove hidden from public view.  If culture and tradition, why such secrecy and shame? Albert Schweitzer, in a call to unveil the cruel activities in the name of tradition everywhere, stated “The thinking (person) must oppose all cruel customs, no matter how deeply rooted in tradition and surrounded by a halo. When we have a choice, we must avoid bringing torment and injury into the life of another.” What is deplorable is the disparity between how dolphins and other animals are treated, even within Japan.   The current techniques employed in the drive hunts violate even current animal welfare regulations within Japan where domesticated animals are afforded protection under their equivalent of the Animal Welfare Act. These guidelines intended to minimize pain, suffering, fear, and “agony” are outlined for species such as horses, cattle, sheep, pigs, dogs, and other animals under human care or management.  Dolphins and whales are not protected by this law, nor are they afforded protection under the wildlife protection and hunting laws. Instead, dolphins and whales fall under the jurisdiction of the Fisheries Agency under the Department of Agriculture, which affords them little protection.  This is in sharp contrast to the protection for dolphins and whales in legislation in other parts of the world where the slaughter of whales and dolphin is strictly prohibited and even their harassment incurs penalties.

Even Japan’s stranding guidelines, issued by the very same agency (Japan Fisheries Agency) responsible for issuing quotas for the dolphin hunts across Japan, cite the necessity of involving a veterinarian in the humane euthanasia or slaughter of a stranded dolphin, and only under extreme circumstances where the individual animal is not likely to survive.  Here, the stranding manual suggests that the spinal incision method, similar to killing method in the drive hunts (without the utilization of the wooden plug), ‘gives psychological damage to observers’ and that spectators should be eliminated from the site, and drugs used instead to “execute” small cetaceans such as dolphins.  In the drive hunts, dozens are killed at a time, dragged to the shoreline by their tailstocks after an exhausting round up at sea.  Under many commercial slaughter regulations, and even compassionate euthanasia standards, it is required that animals should not be in close proximity when killed to avoid the distress associated with the sight, sounds, and smells of slaughter. For example, in the US and UK, the regulations and guidelines governing the humane treatment and slaughter of animals prohibit the killing of an animal in the presence of other animals. From a scientific, humane, and ethical perspective, the treatment of dolphins in these drive hunts sharply contradict current animal welfare standards employed in most modern and technologically advanced societies.

There has been some hard pushback on the paper, because it could be interpreted to be arguing that if the Taiji fishermen simply used accepted livestock slaughter practices then the drive hunts would be okay. While I think the pushback makes a legitimate criticism of the report, there is a benefit to detailing how completely abhorrent–and completely distinct from the slaughter of ANY animal– the Taiji killing methods are. Yes, every discussion about the Taiji dolphin drive should make crystal clear that it should end, without qualification, and that the entire concept of herding and killing dolphins is inhumane and immoral, period. But to the extent that the report shocks people with a deeper understanding of the unusual and extreme cruelty involved, I think it helps build revulsion and opposition to the very idea of the Taiji dolphin drives, regardless of whether the fishermen ever tried to adopt more accepted livestock slaughter practices. That is important.

Marc Bekoff On The Taiji Slaughter

Bekoff, a leading ethologist, adds his voice to discussion of the newly published “A Veterinary and Behavioral Analysis of the Killing Methods Used in the Dolphin Drive Hunts in Taiji, Japan.” His main point–everyone needs to work together, and be patient, to change the painful reality of the drive hunts:

I realize that some people want much more action and they want it now. They are frustrated by the slow progress that is being made on the egregious and thoroughly unethical and inhumane murder of these amazing sentient beings. However, this press is a very good and much needed move for continuing to raise awareness of what is happening in Taiji. Many people really do not know about it. I surely understand the passion of those who want more and want it now. How could anyone sit back and let this brutal slaughter go on as if it isn’t really happening. It is, and countless gallons of the blood of these highly sentient beings are being spilled into the waters around Japan. Shame on those who kill the dolphins and shame on people who know about and who remain indifferent to this massacre. We all need to work together to stop the blood spills.

Those who share common goals must work for the animals and not against one another. There really is strength in numbers. For example, the frustratingly slow progress made over many years on gaining protection for chimpanzees is finally paying off (see also). A strong and unified community effort is needed to help the dolphins along and to stop this bloodthirsty, bloodcurdling bloodbath.

Hard to argue with that.

Is The Taiji Dolphin Slaughter Cruel?

Not that there was much doubt, but a scientific paper categorizes and defines the level of extreme cruelty. The DotEarth blog digs in:

In a new peer-reviewed study, scientists assess the killing method employed by the dolphin hunters of Taiji, Japan, by watching video recorded surreptitiously in 2011 by a German dolphin-protection group, AtlanticBlue. The still image at right is from the video, which can be seen here (but be forewarned; this is not suitable for children — or many adults, for that matter).

Here’s the researchers’ not-so-surprising prime conclusion:

This killing method does not conform to the recognized requirement for “immediate insensibility” [some background is here] and would not be tolerated or permitted in any regulated slaughterhouse process in the developed world.

Annually in Japanese waters, small cetaceans are killed in “drive hunts” with quotas set by the government of Japan. The Taiji Fishing Cooperative in Japan has published the details of a new killing method that involves cutting (transecting) the spinal cord and purports to reduce time to death. The method involves the repeated insertion of a metal rod followed by the plugging of the wound to prevent blood loss into the water. To date, a paucity of data exists regarding these methods utilized in the drive hunts. Our veterinary and behavioral analysis of video documentation of this method indicates that it does not immediately lead to death and that the time to death data provided in the description of the method, based on termination of breathing and movement, is not supported by the available video data. The method employed causes damage to the vertebral blood vessels and the vascular rete from insertion of the rod that will lead to significant hemorrhage, but this alone would not produce a rapid death in a large mammal of this type. The method induces paraplegia (paralysis of the body) and death through trauma and gradual blood loss. This killing method does not conform to the recognized requirement for “immediate insensibility” and would not be tolerated or permitted in any regulated slaughterhouse process in the developed world.

Read the whole thing, but this exchange is particularly important, I think:

Q. One of the standard replies from Japan on this issue (whether with whales or dolphins) is that we, for example, cherish bison but eat bison burgers. Is there a distinction?

A. You cannot compare bison to dolphins in the cognitive domain. However, bison are not killed in this inhumane manner. Nor are lab rats. In cases in which animals are domesticated for food, most modern countries are striving for better animal welfare practices that minimize pain and suffering during the killing process with the goal to render an animal unconscious quickly before it is killed. This is not the case in the dolphin drive hunts. These are not domesticated animals; they are wild dolphins that are captured within their social groups, mother and young, and slaughtered using a technique that actually prolongs death, pain and suffering. The herding procedures themselves are inhumane and may include forced submersion as the dolphins are dragged by their tails to shore to be killed.

This is not to say that dolphins should be killed. They should not.

This is probably the best answer Reiss could give to the contradiction of supporting animal rights and welfare for certain species, but eating meat produced by practices that are also cruel and inhumane. And I agree that the dolphin slaughter should be stopped quite apart from livestock slaughter.

But it is not really a satisfactory or convincing answer. There is a moral contradiction in eating meat while expressing outrage at the abuse and cruelty involved in the slaughter of other species. You can try to defend one species but not another by creating different categories of animals based on intelligence. But while cows and pigs might not be as intelligent as dolphins, they are sentient beings. They know fear. They know loss. To die is painful and they resist that fate as ardently as any species, no matter how intelligent. In the end, the only position which truly avoids this moral contradiction is to oppose animal slaughter and cruelty for all species.

Update: Lori Marino of Emory University and the Kimmela Center for Animal Advocacy, who has a long and complex history of disagreement on principle with Reiss, pushes back, hard, on another moral contradiction:

So what kind of killing WOULD be acceptable? It is absolutely offensive that anyone who works in the dolphin captivity industry would feel they have anything worthwhile to say about the Taiji dolphin drives. This is not about dolphin welfare any more than murdering humans is. This is about dolphin rights. But those in the captivity industry will continue to milk the welfare issue because it provides them a way to appear to be concerned about Taiji while still supporting the industry that drives the Taiji slaughters.

This video, which was used in the study (Warning: GRAPHIC) is horrific. But I could show you (and have) any number of videos of cows and pigs being slaughtered that you will find equally revolting and objectionable:

A Dolphin “Funeral”?

Pete Thomas digs into yet more circumstantial evidence of the impressive dolphin capacity for awareness, thinking, and feeling:

The waters off Dana Point on Tuesday were the scene of what one boater described as a dolphin funeral procession.

The accompanying footage shows a bottlenose dolphin, presumably a mother, carrying her dead calf on her back, while other dolphins followed close by. (Cetaceans have been known to tote dead offspring in what appears to be mourning behavior, but the phenomenon is rarely witnessed.)

The macabre episode revealed that not every mammal sighting is a cause for celebration, and that dolphins, like people, experience the loss of young and deal with that loss in ways that are both sad and touching.

This is not at all the first time that this sort of profound empathy in dolphins has been witnessed:

The most recent evidence comes from Joan Gonzalvo of the Tethys Research Institute, who since 2006 has been observing the bottlenose dolphin population of the Amvrakikos Gulf in the Mediterranean Sea. During one expedition, the researcher and his team witnessed a heartbreaking scene between a mother dolphin and her deceased newborn calf. The mother could be seen repeatedly lifting the corpse to the surface.
“This was repeated over and over again, sometimes frantically, during two days of observation,” said Gonzalvo. “The mother never separated from her calf…. [She] seemed unable to accept the death.”
Gonzalvo experienced a similar scene a year later, when he came across a pod of dolphins that appeared to be assisting a 3-month-old dolphin that was having difficulty swimming.
“The group appeared stressed, swimming erratically,” he said. “Adults were trying to help the dying animal stay afloat, but it kept sinking.”
“My hypothesis is that the sick animal was kept company and given support, and when it died the group had done their job. In this case they had already assumed death would eventually come — they were prepared.”
In the first case, the mother dolphin seemed to be exhibiting grief at her calf’s death, while in the second case the pod of dolphins seemed to show an understanding that death for their pod-mate was imminent. Taken together, the two cases suggest that the dolphins not only experience grief, but also that they may possess some of the higher level concepts entailed by the emotion. In other words, it seems as if they comprehend, and perhaps even contemplate, their own mortality.

If you consider all the elements that go into mourning, and understand what that means in terms of dolphin cognition and emotion, it makes all the other experiences dolphins have in the course of their lives–especially negative experiences at the hands of humans–that much harder to stomach. Their day is coming, though.
